DESCRIPTION OF THE INITIATIVE AND INFORMATION FOR THE CONSUMER

The initiative is an online sale dedicated to customers of the Foppapedretti S.p.A. online shop. The offer and sale of products through the website www.foppapedretti.it are governed by the following General Conditions of Sale. The General Conditions of Sale are formulated in accordance with the legislation on contracts concluded outside commercial premises and, in particular, with the provisions of the Italian Legislative Decree of 6 September 2005, no. 206 (Consumer Code) and subsequent amendments.

The products presented are offered by Foppapedretti S.p.A., based in Grumello del Monte, via A. Volta 11, VAT no. 00223130162 tel. +39 035830497, email address servizio@foppapedretti.it.

The sale is not intended for public administration.

Accepting the general conditions of sale

  1. By placing the order in the manner set out, the Customer declares that they have read all the information provided during the purchase procedure and that they fully accept the General Conditions of Sale. Foppapedretti S.p.A. reserves the right to change the General Conditions of Sale by giving notice on this page of the website. The General Conditions of Sale applicable are those in force at the time that the order is placed. Any changes will be effective after publication on the website.
  2. Once the online purchase procedure is completed, the Customer will print or save an electronic copy and will keep these general conditions of sale, in compliance with the provisions of articles 49 et seq. of Italian Legislative Decree No. 206/2005 on distance selling.

 

PURCHASE METHODS

  1. The Customer can only purchase the products displayed in the Foppapedretti S.p.A. electronic catalogue at the time of placing the order. These products can be viewed online at the address (URL) http://www.foppapedretti.it, as described in the relevant datasheets. It is understood that the accompanying image in the product description may not be perfectly representative of its characteristics: the colour, size and accessory products may differ from what is shown in the figure. All purchase support information is intended as generic information material and does not refer to the actual characteristics of a single product.
  2. The products are available at the price listed on the website on the date that the order is placed. The prices are inclusive of VAT, which will be shown in detail in the invoice issued for the purchase of the product. The prices do not include transport and delivery costs, which are displayed in the shopping cart before the order is placed and on the payment confirmation page, as well as specified in the order confirmation email sent to the Customer. We always strive to ensure that information published on the website is correct, but the size of the catalogue and the amount of information contained in it mean that a technical issue may occur where a sale price is generated which is different from the actual one. We therefore reserve the right to cancel the order in the event that the price has been published incorrectly. Our Customer Service team will take care of notifying the Customer and giving them the correct information.
  3. The steps for placing the order and for concluding the purchase contract are clearly shown in the sequence of pages on the website through explanatory texts and graphics. In particular, it is advisable to view the information on cancellation, which can be stored and printed at any time. Before sending the order, it is possible to correct any data entry errors.
  4. The correct receipt of the order is confirmed by Foppapedretti S.p.A. through an email reply sent to the email address provided by the Customer. This confirmation message will contain the date and time that the order was placed, along with a ‘Customer Order Number’, which needs to be used in any further communication with Foppapedretti S.p.A. The message repeats all the data entered by the Customer, who undertakes to check that it is correct and to promptly communicate any corrections, according to the methods described in this document.
  5. If the order is not accepted, Foppapedretti S.p.A. guarantees to communicate this to the Customer in a timely manner.

 

PAYMENT METHODS

  1. Credit card

    The payment system currently accepts credit cards including Mastercard, Visa and Maestro, as well as PostePay cards but excluding Visa Electron cards, which are not enabled for online payments. If the goods are purchased by the credit card payment method, the transaction will be authorised at the time of the order.
    • 8.1 If the order is cancelled by the Customer or not accepted by Foppapedretti S.p.A. after the payment has already been made, an invoice and a credit note will be issued. The credit note refund will be carried out by bank transfer on the credit card account.
    • 8.2 Foppapedretti S.p.A. reserves the right to request additional information from the Customer (e.g. landline number) or a copy of documents proving ownership of the card used. In the absence of the required documentation, Foppapedretti S.p.A. reserves the right to refuse to accept the order.
    • 8.3 At no time during the purchase procedure is Foppapedretti S.p.A. able to store the information relating to the buyer’s credit card, which is transmitted via a secure connection directly to the website of the banking institution that manages the transaction. No Foppapedretti S.p.A. computer archive will store this data. Foppapedretti S.p.A. cannot therefore in any circumstances be held responsible for any fraudulent and improper use of credit cards by third parties, at the time of payment for the products purchased.
  2. Paypal

    By choosing this option, you will be redirected to the PayPal website to conclude the transaction. IMPORTANT: currently PayPal payments are only accepted from PayPal-verified Italian PayPal accounts. When ordering, PayPal will immediately charge the amount of the purchase made.   3. Scalapay

    With Scalapay payment system, you can pay in 3 instalments without interests. You will be redirected to the Scalapay website to complete the order.
  4. Advance Bank Transfer

    If payment is made by advance bank transfer, the items ordered will only be sent once the amount due has been actually credited to the Foppapedretti S.p.A. current account.
    The Customer must make a transfer corresponding to the amount specified when confirming the order confirmation, with the following bank details:

    • Payment reference: order number shown on the page and in the order confirmation email

 

DELIVERY METHODS AND COSTS

  1. Foppapedretti S.p.A. can only accept orders for delivery within Italy. However, delivery to the locations of Livigno, Campione d’Italia, San Marino and Vatican City is excluded.
  2. For every purchase made, Foppapedretti S.p.A.

    - issues a receipt, that is placed inside the box of the product shipped. It is possible to request the invoice, which will be sent by e-mail to the e-mail address provided during registration.

    PLEASE NOTE: Check the data entered in the “billing address” field carefully, as it is not possible to change this data once the order has entered the shipping process.
  3. Delivery costs are borne by Foppapedretti S.p.A., subject to a contribution of €12.00 for total orders of an amount below €120.00 and any further Transportation Costs Contributions, which are explicitly highlighted at the time of placing the order. To book a fixed delivery slot, an amount of €4.90 is added to the shipping cost. The payment of the goods by the Customer will take place using the method chosen at the time of the order. No additional amount is due by the Customer other than the order total.
  4. Product availability for sale is limited to the availability of the products themselves and is a condition for the validity of the offers. If the products are out of stock – even temporarily – Foppapedretti S.p.A. has the right to refuse the Customer’s purchase request by formal communication via an email, which may also include information on the availability of replacement products. If the Customer does not request to purchase a product to replace the one that is out of stock, Foppapedretti S.p.A. will refund any sums already paid by the Customer in the shortest possible time and no later than 14 days from the date on which the order was cancelled.
    If the Customer chooses the standard shipping service, the requested products will be delivered within 5-7 working days.
  5. Unless explicitly indicated by the Foppapedretti S.p.A. Customer Service team, delivery is understood to be at street level. Upon delivery of the goods by the courier, the Customer is required to check that:
    • the number of packages delivered corresponds to what is indicated on the accompanying invoice;
    • the packaging is intact, and not damaged, wet or altered in any way, even in the sealing materials (adhesive tape or metallic bands).
    Any damage to the packaging and/or the product or an incorrect number of packages or inaccurate indications must be immediately declared, by placing a NOTIFICATION on the courier’s proof of delivery (example: wet cardboard,…).

    Therefore, when you receive the package, we always advise to write “goods unchecked” on the delivery note. Otherwise, we cannot grant to pick up and refund the damaged product.

    Once the courier document is signed, the Customer cannot make any complaint regarding the external characteristics of the items delivered.

    Any problems relating to product integrity, or products that do not correspond to the order or are incomplete, must be reported within 5 days of delivery, by email to servizioclienti@foppapedretti.it or by filling in the Returns and Refunds form.
  6. Storage: in the case of storage due to non-delivery/collection, you will be contacted by phone to resolve the problem.

 

RIGHT OF RETURN

  1. Any damage to the packaging and/or the product or an incorrect number of packages or inaccurate indications must be immediately declared, by placing a NOTIFICATION on the courier’s proof of delivery (example: wet cardboard,…). Otherwise, we cannot grant to pick up and refund the damaged product.

    Once the courier document is signed, the Customer cannot make any complaint regarding the external characteristics of the items delivered.
  2. Any problems relating to product integrity, or products that do not correspond to the order or are incomplete, must be reported within 5 days from delivery, by email to servizioclienti@foppapedretti.it or by filling in the Returns and Refunds form.
  3. Upon delivery of the goods by the courier, the Customer is required to check that:
    • the number of packages delivered corresponds to what is indicated on the accompanying invoice;
    • the packaging is intact, and not damaged, wet or altered in any way, even in the sealing materials (adhesive tape or metallic bands).
  4. After filling in the Returns and Refunds form within 5 days from delivery date, Foppa Pedretti S.p.A. will analyze the damage and, where possible, will send the spare part to be replaced.
  5. On the contrary, if the damage cannot be repaired with spare parts, and the product has to be returned, it will be refunded using the same payment method used for the purchase; the refund will be made after the product has been returned to our warehouse and after being approved. The product must be returned by the Customer in the original and complete package (including carton and plastic package and any documents and accessories, such as instruction manuals, screws, wheels, etc…).
    Foppapedretti undertakes to reduce its environmental impact also at a logistic level in case of returns.
    The company tries to reduce carbon emissions by limiting the movement of goods.
  6. It is not possible to exchange the item ordered (e.g. changing the colour), without placing a new order on our website.
  7. In case of lack of conformity of the product, Foppa Pedretti S.p.A. provides, at no cost for the Customer, to restore the conformity of the product by repairing/replacing or reducing the price, until resolution of the contract.
    If, for any reason, it is not able to provide a product under warranty (repaired or replaced) to its customer, Foppa Pedretti S.p.A. may decide, at its discretion, to refund the whole amount paid or to replace the product with a similar one with same or higher features.
    In the cases where the warranty allows the return of the product, it must be returned by the Customer in the original and complete package (including carton and plastic package and any documents and accessories, such as instruction manuals, screws, wheels, etc…); to avoid damage to the original package, we advise, when possible, to place it into another package; please always avoid placing labels or adhesive tape on the original package.
  8. If, after intervention by an Authorized Service Centre, the defect results not to be a lack of conformity pursuant to articles 128 and following Law Decree nr. 206/2005, the Customer will be charged for any check and repair costs required by the Authorized Service, as well as the transport costs, if paid by Foppa Pedretti S.p.A.

 

RIGHT TO CANCEL

  1. Pursuant to articles 52 et seq. of Italian Legislative Decree 206/2005, if the Customer is a consumer (i.e. a natural person who purchases the goods for purposes not related to their professional activity), they have the right to cancel the purchase contract for any reason, without the need to provide explanations and without any penalty, except for the types of products for which this is expressly excluded (see article 59 of Italian Legislative Decree 206/2005) and without prejudice to what is indicated in the following point 18.
  2. To exercise this right, the Customer must send Foppapedretti S.p.A. a communication to that effect, within 14 days from the date of receipt of the goods. This communication must be sent by email or by filling in the Returns and Refunds form.

    Once the aforementioned cancellation notice has been received, the Foppapedretti S.p.A. Customer Service team will promptly communicate to the Customer the instructions on how to return the products, which must be sent back to the following address Foppapedretti S.p.A. c/o FOPPAPEDRETTI S.p.A. - Via A. Volta no. 11 24064 Grumello del Monte (BG) - Italy, without undue delay and within 14 days of authorisation.

    The direct costs (packaging and transport) of returning the product for right of withdrawal, are paid by the customer. If the product is collected by a FOPPA PEDRETTI SPA courier, the cost charged for the return is equal to 25,00 euros. In this case the responsibility for the shipment will be of Foppa Pedretti Spa.

    The Customer can also return their goods using a courier of their choice, but, in this case, the shipment is under the full responsibility of the Customer until they are confirmed as received in the Foppapedretti S.p.A. warehouses.

    If the returned product is damaged during transport which is not carried out by the Foppapedretti S.p.A. couriers, Foppapedretti S.p.A. will notify the Customer of the incident within 5 working days from receipt of the returned goods in its warehouses. This will allow the Customer to promptly complain to the courier chosen by them and to obtain a refund for the value of the damaged product (in this case, the product will be made available to the Customer and the cancellation request will be withdrawn at the same time);

    Foppapedretti S.p.A. is in no way liable for damage or theft/loss of goods returned by shipments which are managed by the Customer’s courier.
  3. The right to cancel is however subject to the following conditions: the right applies to the product purchased in its entirety; it is not possible to cancel only part of the purchased product (e.g. accessories, etc. ...).

    The purchased goods must be intact and returned in their original packaging, with all parts complete (including packaging and any documentation and accessory equipment: manuals, etc. ...). To limit damage to the original packaging, we recommend placing it in a second box, and affixing labels or adhesive tapes directly on the original product packaging must be avoided in all cases.
  4. Foppa Pedretti S.p.A will refund to the customer the full amount already paid (less the direct costs of returning as described in the previous paragraph 18 in case the products are not returned directly by the customer) within 14 days from receipt of the notice of withdrawal through the payment method chosen at the time of the purchase.

    Foppa Pedretti S.p.A will refund after receiving the product in its warehouse. Foppa Pedretti S.p.A will make the refund net of shipping costs for the return of the product. The cost charged for the return will be € 25,00.
  5. The right to cancel does not apply if the goods (packaging and/or contents) are not in the required intact condition, in cases where Foppapedretti S.p.A. ascertains that:
    • after delivery, the seal has been opened on audio or video recordings or on sealed computer software;
    • integral elements of the product are missing (accessories, components or manuals ...).
    In the case of forfeiture of the right to cancel, Foppapedretti S.p.A. will communicate this by email; the product will remain available to the Customer at the Foppapedretti S.p.A. warehouse for a period of 30 (thirty) days from the date of sending the registered letter.

    After this term, the product will be disposed of without further notice.

 

WARRANTIES

  1. All products sold by Foppapedretti S.p.A. are covered by the manufacturer’s conventional warranty and by the 24-month warranty for lack of conformity, pursuant to articles 128 et seq. of Italian Legislative Decree no. 206/2005. To benefit from the warranty, the Customer must keep their invoice/virtual receipt or the delivery note that they received by email or at their address home on delivery.
  2. The manufacturer’s conventional warranty is provided in the manner described in the documentation inside the product packaging. If, following intervention by an Authorised Service Centre, the defect is not covered by the manufacturer’s conventional warranty, the Customer will be charged for any verification and restoration costs required by the Authorised Service, as well as the transport costs, if paid for by Foppapedretti S.p.A.
  3. The 24-month warranty pursuant to articles 128 et seq. of Italian Legislative Decree no. 206/2005 applies to products with any lack of conformity, provided that the product itself is used correctly, in compliance with its intended use and in line with the attached technical documentation. This warranty is reserved for the Private Consumer (the natural person who purchases the goods for purposes not related to their professional activity). In the event of a lack of conformity, Foppapedretti S.p.A. will, at no cost to the Customer, restore the conformity of the product by repairing/replacing it, or will reduce the price, until the contract is terminated. If, following intervention by an Authorised Service Centre, the fault is not a lack of conformity according to articles 128 et seq. of Italian Legislative Decree no. 206/2005, the Customer will be charged for any verification and restoration costs required by the Authorised Service, as well as the transport costs, if paid for by Foppapedretti S.p.A.
  4. In the case of DOA (Dead On Arrival: product not working on delivery) replacements will be carried out only if expressly provided for by the manufacturer. The timing of the product replacement or repair depends exclusively on the policies of the manufacturer.
  5. In the event that, for any reason, Foppapedretti S.p.A. is unable to return a product under warranty (restored or replaced) to its Customer, it may proceed at its discretion to refund the entire amount paid or to replace the product with a product with equal or superior characteristics.
  6. No damage can be requested from Foppapedretti S.p.A. for any delays in carrying out repairs or replacements.
  7. If the application of the warranties requires that the product is returned, the goods must be returned by the Customer in their original packaging, with all parts complete (including packaging and any documentation and accessory equipment: manuals, accessories, etc. ...). To limit damage to the original packaging, we recommend, where possible, placing it in a second box, and affixing labels or adhesive tapes directly on the original product packaging must be avoided in all cases.

 

PRIVACY

  1. The Data Controller is Foppapedretti S.p.A. The Data Controller is independent and carries out the processing necessary for the pursuit of the purposes in accordance with the Italian Legislative Decree no. 101 of 10/08/2018 which implemented the EU Regulation 2016/679 (GDPR).

APPLICABLE LAW

  1. The sales contract between the Customer and Foppapedretti S.p.A. is concluded in Italy and governed by Italian law. For the resolution of civil and criminal disputes arising from the conclusion of this distance selling contract, if the Customer is a consumer, the territorial jurisdiction is that of the reference court of their municipality of residence; in all other cases, the territorial jurisdiction is exclusively that of the Court of Bergamo.

 

COUPON AND DISCOUNT TICKETS

  1. Each coupon can be used in relation to the promotion of the single purchase and cannot be combined with other coupons and/or other promotions in force.
  2. It cannot be transferred to other users.
  3. It does not give right to change, it will not be refunded, in whole or in part, and must be used by the expiry date.
  4. Failure to use the coupons in the ways indicated and within the period of validity will entail their forfeiture.
  5. In the case of coupon codes with a fixed amount, if their value is not enough to cover the total amount of the order, the buyer can provide, paying the difference through the forms of payment allowed by the website.
